What Happens If a Building and Pest Inspection Finds Major Defects in Brisbane?
You’ve found the right home, signed the contract and booked your building and pest inspection. Then the report lands in your inbox and one phrase jumps out: major defect.
It’s a stressful moment. But it’s also exactly why you got the inspection. In Queensland, a building and pest inspection condition in your contract gives you real options when serious problems turn up. You don’t have to walk away, and you don’t have to buy blind either.
In this guide, we’ll explain what a major defect actually means, what your contract lets you do, and how Brisbane buyers usually handle the next few days.

What Counts as a Major Defect in a Building and Pest Inspection
Under AS 4349.1, the Australian Standard for property inspections, a major defect is one serious enough that it needs fixing to avoid unsafe conditions, loss of use or further damage to the building. A scuffed wall or a dripping tap won’t make that list.
Common major defects we find in Brisbane properties include:
- Active termites or significant timber pest damage to stumps, bearers, joists or wall frames
- Structural cracking in brickwork, slabs or retaining walls
- Roof problems like rusted sheeting, cracked tiles or failed flashings letting water in
- Rising damp, poor drainage and moisture damage, often worse after summer storms
- Safety hazards such as unsafe stairs, balconies or balustrades
Your report separates building defects from timber pest damage. That difference matters. A building defect relates to how the home was built or how it’s aged. Pest damage can point to an ongoing problem if the colony is still active. You can read more about how termite risk is rated in your inspection report.
Older timber homes in suburbs like Ashgrove, Paddington and Wavell Heights need extra attention. Queenslanders on stumps with damp subfloors are exactly what termites look for.
Your Options Under a Queensland Contract
Most Brisbane buyers sign the standard REIQ contract. If an inspection date is filled in, your purchase is conditional on getting a building and pest report you’re satisfied with, acting reasonably, by 5 pm on that date. Leave the date blank, and that protection is gone.
When the report shows major defects, you’ve generally got four choices.
1. Negotiate the price. This is the most common outcome. Get repair quotes, then ask the seller for a price reduction or a credit at settlement.
2. Ask the seller to fix it. Some sellers will repair defects before settlement. Make sure a licensed tradie does the work and that it’s checked before you settle.
3. Terminate the contract. If the problem is serious and you’re acting reasonably, you can end the contract under the condition. The seller can ask for a copy of your report, so a clear, detailed report matters here.
4. Go ahead anyway. You can waive the condition and buy the property knowing what needs fixing.
Here’s what many buyers miss. Ending the contract under the building and pest condition is different from using your cooling-off period. Cooling off in Queensland costs you 0.25% of the purchase price. Terminating under the condition doesn’t carry that penalty. Always confirm the right path with your conveyancer or solicitor before the deadline.
What to Do in the First 48 Hours
Time is the one thing you can’t get back. Once you have the report, work through these steps:
- Read the summary first. Look at the photos and the overall assessment before getting lost in the detail.
- Call your inspector. Ask how serious each issue really is, whether termite activity is live, and what could happen if it’s left alone.
- Bring in specialists where needed. A structural engineer for major cracking, a licensed pest controller for active termites, or a roofer for roof defects.
- Get written quotes. These become your evidence when you negotiate.
- Check your deadline. If you need more time, your conveyancer can ask the seller for an extension. The seller doesn’t have to agree.
This is where report speed makes a real difference. With a seven-day inspection condition, a report that turns up on day five leaves you almost no room to move. Zoom BPI delivers your report within 24 hours, so you’ve got time to get quotes and negotiate properly.
Roof defects are a good example. A worn roof can cost more than buyers expect, and it often shifts what a property is worth. Here’s how roof inspection issues affect property prices.

Buying at Auction? Get Your Building and Pest Inspection First
Auctions work very differently. Queensland auction contracts have no cooling-off period and normally no building and pest condition. If major defects turn up after the hammer falls, they’re yours to fix.
That’s why you need your building and pest inspection done before auction day, not after. It tells you what you’re bidding on and helps you set a sensible limit.
